2005 Senate Bill 1325 (Sex Offender Provisions)

  • Introduced by Sen. Dave Kleis on February 28, 2005, to make a variety of changes with regard to public safety and sex offender laws. Among the substantive changes, this bill: 1) provides for a mandatory life sentence for first degree sex offenders with out the possiblity of any supervised release until they have served a minimum of 20 years in prison, 2) provides for life sentences without the possibilty of release if the offense occured with aggravating circumstances such as torture, great bodily harm, use of a dangerous weapon or an offense against someone under 13 or over 70, 3) increases mandatory minimums for most sex crimes, 4) creates a criminal sexual predatory conduct crime where the person commits a predatory crime motivated by the offender's sexual impulses. A person convicted under this provision would serve a minimum term of double the minimum for the same crime minus the sexual impulse motivation, 5) sets up a registration procedure for persons without a primary address requiring that the sex offender register with local law enforcement within 24 hours of entering a jurisdiction, and requiring that the person report to the local law enforcement agency weekly. The bill also requires that photographs be taken on a scheduled basis, and provides for community notification for out-of-state offenders, 6) increases the period of conditional release for sex offenders from 5 to 10 years, and lifetime conditional release for repeat offenders, and 7) establishes a sex offender policy board to develop standards for treatment and supervision of sex offenders (HF1406 Companion Bill).

So we have two 'stories' on this topic from people who had sex with minors when they were older than 18. One story doesn't give ANY details about the girls age, and the other story says that she was 13 and a half.

THIRTEEN YEARS OLD!

Buddy (or gal, or whatever), if you are 18 years old and you are having SEX with THIRTEEN YEAR OLDS, or 14 year olds, or 15 or 16 year olds for that matter, you should be thrown in the slammer and throw away the key.

End of story.

Ignorant or enlighten, let she (or he) who is among you without a youthful sin (or stupid indiscretion) cast the first stone at me or should I say be so ignorantly quick to rush to judgment concerning the judicial "Sex Offender" label which has been branded on me.

I had an underage girlfriend two decades ago back in 1985, that's: 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20 years ago, back when I was a very, very immature, young adolescent adult. My poor stupid choice to get romantically & carnally involved with the consenting statutory "victim", is a mistake from a very long time ago which my wife & I would like to not be forced to constantly revisit. I thought I paid my debt in full to society way back then when I successfully completed a court ordered outpatient group treatment program designed for nonviolent sex offenders and served 17 days in a work release facility. I haven’t been on supervised probation since 1990, which was BEFORE the new registration laws passed in 1993.

Creating & passing more & more new sex offender registration, so-called "Public Safety", state laws then applying them retroactively to me for an 18 year old misdemeanor conviction is out-of-control legislation. If the retroactive (expo facto) application of this laws isn't UNJUST enough to discuss you then how about the UNJUST bases for the sex offender registration requirements NOT being based on my conviction (misdemeanor) or guilt but rather the original charge{s} (prosecution complaint) which were amended & dropped once in court?

I believe that my so-called protected federal “Constitutional Rights” have been grossly violated on this one.

For me to have to write this and for you to have to read this is a total waste of both of our time. May GOD have mercy on each and every one of those responsible for this injustice, AMEN!

You should have zero rights. You should be labelled a sex offender for as long as your victim suffers from your thoughtless actions. As a victim, I can tell you that I was victimized 45 years ago. My perp died of a massive stroke when I was 7. To this day I have to live with my victimization. Own your actions, and live with the consequenses.

my name is krystle my fiance is in prison serving 5more yrs for a similiar situation if u wiuld be so kind as to enlighten me on how u were able to live with u legally id appreciate it i live in indiana and my fiance has nowhere to go when he gets out and financially i cant afford to house him and myself separetly til he would be able to get on his feet what options do i have and how do i go bout them?

If a guy had an under-age carnal girlfriend when he was a young adult albeit sinful and unlawful I would consider it more so a stupid immature adolescent indiscretion, even if they did just have a passing fling and/or were genuinely in love. To BRAND him a registered sex offender for life and put him into an unforgivable category with rapists and pedifiles is just NOT right.

Let me tell you a story from the opposite side of the debate.

I am a registered sex offender, sentenced and thrown in prison on a technicality.

There is violent offenders, and yes, they should be handled as such. But you people are missing the real problem here. Kids, high school kids, that don't know anything about sex because their parents don't give them "the talk" and then when they experiment with it they get in trouble.

I was sentenced for having sex with a girl that was 4 1/2 years younger than me, it was just before my 18th birthday, but because it never came to light until after i turned 18 i was charged as an adult. Despite the fact that i was a minor at the time, a minor that had no clue about sex and life, and ended up experimenting with sex with a willing partner.

Who by the way never once did anything to help the case, and her parents forced the issue after finding out their daughter had sex with a guy that she had been dating anyway. I had supper with her and her family on a regular basis, her parents knew we were dating, but thought that we knew what we were doing.

Well, we didn't. Thank god we knew enough to use protection and she didn't get pregnant, but we didn't know what we were doing. I realize that all the more after going through a treatment program. They taught me that i should not love or trust a woman, you heard me right, i stayed away from women for some time. Even those that were my age or older, i just felt like it was wrong to have sex with any woman.

It took me a long time to recover from the head games they played with me. It took me even longer before i could commit myself to a new relationship. And now i live happily with my wife and two children, but, i still get the "sex offender" treatment when i try to get a job to support my family. I also have trouble getting housing to allow my family to live comfortably because nobody wants to live next to the "sex offender" down the block.

So i say, screw you all. You don't know the whole story, you don't know each offender. You just paste a label on them because its convenient to handle it quickly. You spend thousands on incarceration of them, but you won't spend a dime on treatment. I had to pay for my treatment out of my own money because while i was in prison i was on a four year waiting list for the in house treatment program, when i only had 21 months to serve in the first place!

Spend some money on helping them in the first place. Spend money on educating our kids about sex. Some say we only put ideas in their head with sexual education, i say you put the resources they need to make better decisions in their heads. Sure, some may still make mistakes, but, to err is human!
